1. Who we are
Zolarflow ("Zolarflow", "we", "us", "our") is operated by Enkova s. r. o., with registered address at Lehotská 370/22, 972 71 Nováky, Slovakia ("Company"). By creating an account or using Zolarflow (the "Service"), you ("you", "User") agree to these Terms & Conditions ("Terms"). If you do not agree, do not use the Service.
2. Acceptance & authority
By continuing to use the Service you confirm that (a) you are of legal age in your country, (b) where you act on behalf of an organisation, you have the authority to bind that organisation, and (c) the information you give us is accurate and kept up to date.
3. The Service
Zolarflow is a closing CRM that helps users manage contacts, follow-ups, calling queues, bookings, and transactional emails. We grant you a limited, non-exclusive, non-transferable right to use the Service within the limits of your subscription plan.
4. Acceptable use
You agree that you will not, and will not allow anyone else to:
- use the Service for anything unlawful, fraudulent, or harmful;
- send spam, unsolicited bulk email, or any communication that breaches anti-spam laws (including GDPR/ePrivacy and CAN-SPAM);
- infringe anyone else's intellectual property, privacy, or other rights;
- upload malware, scrape, probe, or otherwise interfere with the security or integrity of the Service;
- reverse engineer, resell, sublicense, or redistribute the Service;
- circumvent technical limits, rate limits, or quotas.
5. Fair use of email & calling features
The Service includes outbound communication features (email sending, calling queues, booking reminders). To protect deliverability, recipients, and other users, the following are strictly prohibited:
- sending to purchased, scraped, or otherwise non-consented contact lists;
- impersonating any person or organisation;
- bypassing unsubscribe requests or suppression lists;
- using the Service to generate excessive volumes that abuse shared infrastructure.
We use automated abuse detection. If your usage triggers spam complaints, hard-bounce rates, or volumes that we consider abusive, we may (without prior notice) throttle your account, suspend sending, charge you for additional infrastructure costs incurred, and/or terminate your account.
6. Your account & content
You are responsible for keeping your login credentials confidential and for all activity under your account. You retain ownership of the data and content you upload ("User Content"). You grant us a limited licence to host, process, and transmit User Content solely to provide and improve the Service.
7. Intellectual property
The Service, including its software, design, documentation, and branding, is and remains the property of the Company and its licensors. Nothing in these Terms transfers any IP rights to you other than the limited usage right described in Section 3.
8. Payments, subscriptions & taxes
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Billing, taxes, invoicing, renewals, and cancellations are handled in accordance with the Paddle Buyer Terms.
Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel any time via paddle.net or from your account settings; cancellation takes effect at the end of the current paid period.
9. Refund policy
We offer a 14-day money-back guarantee. If you are not satisfied with your purchase, you may request a full refund of your most recent payment within 14 days of the order date.
Refunds are processed by our payment provider, Paddle. To request a refund, visit paddle.net or contact us and we will help you raise the request. After the 14-day window, payments for the current billing period are non-refundable, but you can still cancel future renewals at any time.
We may decline refund requests where there is clear evidence of abuse of the guarantee (for example, repeated subscribe/refund cycles or use of the Service to send abusive volumes during the refund window).
10. Service availability
We work hard to keep the Service running, but we do not guarantee that it will be uninterrupted, timely, secure, or error-free. The Service is provided "as is" and "as available", and to the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
11. Suspension & termination
We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay, present a security or fraud risk, or repeatedly or seriously violate our policies. You may stop using the Service at any time. On termination, your right to use the Service ends; we may delete your data after a reasonable export window, unless retention is required by law.
12. Liability
To the fullest extent permitted by law, our aggregate liability under or in connection with these Terms is capped at the fees you paid us in the 12 months immediately before the event giving rise to the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, revenue, data, or goodwill. Nothing in these Terms limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded under applicable law.
You agree to indemnify us against third-party claims arising from your User Content, your unlawful use of the Service, or your breach of these Terms.
13. Changes to the Service or Terms
We may update the Service and these Terms from time to time. If we make material changes, we will let you know in-app or by email. Continued use of the Service after changes take effect means you accept the updated Terms.
14. Governing law & disputes
These Terms are governed by the laws of the Slovak Republic. Any disputes will be subject to the exclusive jurisdiction of the competent courts of the Slovak Republic, without prejudice to any mandatory consumer-protection rights you may have in your country of residence.
